A major loss for the Trump Administration
A growing national legal battle over temporary U.S. attorney appointments has reached a critical point in New Jersey, where Acting U.S. Attorney Alina Habba’s authority is under intense scrutiny. A federal judge has already determined that Habba has been serving unlawfully since her interim appointment, made by President Donald Trump, expired in July. Although she remained in the position, the administration’s appeal faces long odds as courts around the country hand down similar rulings.
Now, this morning, the U.S. Court of Appeals for the Third Circuit unanimously reaffirmed that Habba is disqualified from serving as acting U.S. attorney, marking the first appellate decision on the administration’s controversial approach to interim federal prosecutor appointments, and the result was a 3–0 setback for Trump.
This morning, the 3rd Circuit ruled that Habba was not only disqualified as acting U.S. Attorney, but she was also disqualified as serving as the U.S. Attorney. Read the full order here.

...U.S. District Judge Matthew Brann ruled in August that Habba has been serving without lawful authority since the beginning of July, when she was tapped to temporarily lead the U.S. Attorney's Office in New Jersey. Brann said she must be disqualified from participating in ongoing cases.
